Terms & Conditions (general)
In these terms and conditions the words have the following meanings –
“Culture” means Concrete Culture Australia Pty Ltd
“Commencement” means the date Culture begins work at the site
“Works” are defined as but not limited to site preparation, form work, pouring and processing
“Grade of fall” the grade of concrete to fell water away from dwellings, pools and structures into drainage areas such as gardens or pits
“Crack control” placement of cracker bars, tool joins/joints or saw cuts which prevent structural cracking
a. A quotation will be issued by Culture to the Customer prior the commencement of any works.
b. Works will not commence at the location until the quotation is accepted in writing by the Customer.
c. Variations to the quotation will not be accepted after concrete has been ordered from the concrete supplier.
d. Any variation requested after the commencement of works and after concrete has been ordered, will be charged in addition to the original quotation. Any such requests must be submitted to Culture both verbally and confirmed via email.
a. 50% of the total cost to be received 7 days prior to the commencement of works.
b. Balance is to be paid within 7 days of completion.
c. Interest on all overdue amounts to be charged at 2% plus the rate set from time to time by Schedule 2 of the Penalty Interest Rates Act 1983 (Vic).
d. All legal costs and disbursements howsoever incurred in recovering any overdue invoice will form part of any claim for unpaid monies.
3. Commencement of works
a. Culture will provide the Customer with an indicative commencement date upon Quotation.
b. The commencement and completion of works will be weather permitting.
4. Site preparation
a. Site preparation works will be undertaken by Culture.
i. The site is to be clear of rubbish and debris prior to commencement of works. Any cost to Culture to clear the site prior to commencement will be at an additional cost to the Customer.
b. Base preparation allowance is 50mm of Class 4 Crushed Rock (or product to a similar standard);
c. Plumbing works are to be completed by a Licenced Plumber, where required, and are to be completed prior to commencement of works. Works are to include drainage pits.
d. Electrical works are to be completed by a Licensed Electrician, where required, prior to Culture commencing works.
e. Temporary fencing must be available at the site prior to the commencement of works. The Customer must ensure there is adequate fencing to encompass all concrete works in accordance with Council specifications contained in the relevant Building Permit.
f. Culture does not take responsibility for damage caused by animals. Pets are to be kept clear of the worksite during the period of work.
a. Culture may, at its discretion, refuse a Customer’s request to vary its work if Culture considers that request is unreasonable and is not within the scope of the works.
b. Culture considers that plans provided by landscape designers or architects may be concept only plans and may not be feasible upon installation. Variations to concept plans may incur additional expenses which Culture will discuss and quote prior to commencement of works.
c. Culture may, within 14 days prior to the commencement of works, attend the location to undertake a site assessment only after the Customer has accepted the Quotation.
d. The grade of fall will be at Culture’s discretion.
e. Crack control will be placed and inserted at Culture’s discretion.
f. Culture will apply a sealer of its choice at the completion of the works. Sealer should be applied at least every 12 months. Culture does not guarantee longevity of the sealer applied in smooth surface finishes (also known has “hard trowel”).
g. Culture’s pool coping tolerance will be within 8mm per lineal meter of straight form.
a. Culture does not remove rubbish from the site at the completion of the works. Culture’s rubbish will consist of plastic, excess concrete, mesh, crushed rock and the like. Rubbish does not include general waste.
b. A final inspection will be arranged with the Customer and Culture at a mutually agreed date and time, prior to completion of the works.
c. The Customer has seven days from the date of completion of the works to notify Culture of any defect.
